1. Introduction
These Terms of Service set out the rules and regulations for your use of Google Pay functionality as made available through the Keytom services (“The App”) that you, the individual user, access. The Google Pay integration is provided to enable contactless payments via Google’s proprietary platform.
The Google Pay functionality within the App is offered by KEYTOM SERVICES LTD and Virtual Assets Service Provider Keytom Solutions s.r.o. (hereinafter “KEYTOM”):
The Google Pay functionality is provided by Google LLC, a company incorporated under the laws of the State of Delaware, USA, with its principal place of business at 1600 Amphitheatre Parkway, Mountain View, California, USA (“Google”).
By browsing, accessing, or using the App and activating Google Pay functionality, you hereby agree to these Terms and Conditions (the “Terms”), which constitute a binding legal agreement between you (the “User” or “You”), KEYTOM, and Google. Your use of Google Pay is further governed by Google’s own terms and conditions applicable to Google Pay users.
2. Definitions
For the purposes of these Google Pay Terms of Service:

3. Supplemental Terms and Amendments
These Google Pay Terms incorporate by reference any supplemental terms and conditions or documents posted within the App from time to time, including but not limited to updates related to Google Pay functionality.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. You will be notified of any changes by the updated “Last updated” date shown at the top of these Terms. By continuing to use Google Pay through the App after such changes are posted, you acknowledge and accept the amended Terms. If you do not agree with the amended Terms, you must immediately discontinue your use of Google Pay functionality within the App.
Please note that your use of Google Pay is also governed by Google’s own Terms of Service for Google Pay, available at https://payments.google.com/payments/apis-secure/get_legal_document?ldo=0&ldt=googlepaytos&ldl=EN. It is your responsibility to review and comply with all applicable Google terms in addition to these Terms.
4. Age and Eligibility
You may use Google Pay functionality within the App only if you:

5. Use of Google Pay and Limitation of Liability
You may use Google Pay within the App solely for lawful payment purposes in accordance with these Terms, Google’s Terms, and all applicable laws and regulations.
KEYTOM provides access to Google Pay functionality only as an integration within the App. KEYTOM does not process Google Pay payments directly and is not responsible for:
You acknowledge and agree that Google Pay is operated exclusively by Google LLC, and any issues regarding the Google Pay platform, including transaction failures or technical difficulties, must be resolved directly with Google and/or your card issuer.
8. Governing Law and Jurisdiction

By enabling and using Google Pay, you acknowledge and agree that certain information, including transaction details, device information, and account identifiers, may be shared between KEYTOM, Google, your card issuer, and other payment processors as necessary to facilitate Google Pay transactions and comply with applicable laws.
To the maximum extent permitted by law, KEYTOM disclaims any liability for damages, losses, or claims arising from your use of Google Pay, including but not limited to failed transactions, service unavailability, or unauthorised access to your Google Pay account.
6. Privacy and Data Sharing
Your use of Google Pay within the App is subject to:
You acknowledge that Google may also suspend or terminate your use of Google Pay at its discretion, without notice to KEYTOM. In such cases, KEYTOM is not liable for any resulting loss, damage, or inability to use Google Pay functionality within the App.
Upon termination, all rights granted to you under these Terms with respect to Google Pay will immediately cease.

Any disputes arising out of or relating to these Terms or your use of Google Pay within the App shall be subject to the exclusive jurisdiction of the courts of Canada or the Czech Republic, depending on which KEYTOM entity is providing the specific service giving rise to the dispute.
You agree not to contest the jurisdiction and venue of these courts and waive any objection on the grounds of inconvenient forum or any similar grounds.

7. Termination and Suspension
